The following terms and conditions (“Terms and Conditions”) govern your access to the Website Aba.pr (“Website”), owned by Aba Centro de Electrólisis (“ABA”), and your purchase and use of the products (“Products”) and/or services (“Services”) offered through the Website, as well as all purchases and transactions made with ABA.

  1. ACCEPTANCE OF TERMS:

By using the Website or purchasing any of our Products and/or Services, you accept the Terms and Conditions included below. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY as they may have changed since your last visit. If we make changes to these Terms and Conditions, we will notify such changes by sending an email, posting a notice on the Website, or updating the “Last Updated” date at the beginning of these Terms and Conditions. By continuing to access or use the Services, making purchases, and/or receiving or using ABA Products, you confirm that you accept the revised Terms and Conditions and all the terms incorporated therein by reference. We recommend that you regularly check the Terms and Conditions to ensure that you understand the terms and conditions that apply when you access or use the Website or when you make a purchase and/or receive or use the Products offered through the Website. If you do not accept the revised Terms and Conditions, you will not be able to access or use the Website, place orders, make purchases, and/or receive or use the Products or Services offered through the Website.

  1. PRIVACY POLICY:

Please refer to our Privacy Policy for information on how we collect, use, and disclose your information.

  1. ELIGIBILITY:

The Website is not targeted or intended for children under the age of 21. By using the Website and the Products and/or Services offered through the Website, you represent and warrant that (a) you are 21 years of age or older; (b) you have not previously been suspended or removed from the Website or engaged in activities that could result in your suspension or removal from the Website; (c) you do not have more than one account at Aba.pr, and (d) you have full power and authority to accept these Terms and Conditions, and in doing so, you will not violate any other agreement to which you are party.

  1. SIGNING UP, ACCOUNT, AND COMMUNICATION PREFERENCES

To access and use certain Website areas or features, you will need to sign up and obtain an account at Aba.pr (hereinafter, the “Account”). By creating an Account, you agree to (a) provide accurate, current, and complete information about yourself; (b) maintain and promptly update your Account information, as necessary; (c) keep your Account credentials (username and password) secure; (d) be responsible for the acts or omissions of any third party authorized to access or use the Website on your behalf, and (e) notify us immediately if you discover or suspect any security breach related to the Website or your Account.

By creating an Account on the Website, you also agree to receive electronic communications from ABA (such as via email or by posting notices on the Website). These communications may include notices about your Account (e.g., payment authorizations, password changes, and other transactional information), which are part of your relationship with us. You must keep copies of our electronic communications by printing them or keeping electronic copies. We may also send you promotional communications by email, including but not limited to newsletters, special offers, surveys, and other news and information that we think will be of interest to you. You can opt out from receiving these promotional emails at any time by pressing the “Unsubscribe” button available in any email with promotional or advertising content, and following the instructions provided through the link. You may also opt-out from receiving such communications during the process of signing up and creating an Account on the Website.

  1. TERMS OF SALE

The following Terms and Conditions govern the purchase of Products and/or Services on the Website or at any of ABA’s establishments in Puerto Rico.

5.1 Pricing

  1. The price shown reflects the cost per visit.
  2. You may prepay up to five offers while the offer is valid.
  3. Prepaid Services (including, but not limited to, Laser and/or Electrolysis treatments) must be used within a period of 5 years from the date of purchase. When buying more than one treatment for the same body area, the person should make sure to use all the treatments within the aforementioned period. The prepaid services may not be used after the expiration of the 5-year term. No refunds will be issued for Services paid and not used within the corresponding term.
  4. Offers are non-transferable and cannot be combined with other offers.
  5. Prices do not include the Sales and Use Tax (IVU).
  6. We don’t issue cash refunds.
  7. You will need to show evidence of your online purchase at the time of redeeming the Services at the offices of Aba Depilación Laser.
  8. The prices shown on the Website are valid at the moment you see them, but they may change at any time and without prior notice. The prices shown on pages stored by internet service providers, network servers, your device, or any other system may not be up to date.
  9. All prices are listed in US dollars. Applicable taxes and other charges, if any, are not included.

5.2 Initial Treatment, Touch-Ups, Limitations

  1. Definitions
  2. Initial Treatment: The first stage of Laser Hair Removal treatment, which consists of 5 sessions to be performed in the area to be treated. Hair grows in stages, so in each session, the laser hair removal treatment uses heat to directly target the follicles of any newly growing hairs until their growth is reduced.
  3. Touch-Up(s): This stage deals with the hair that has survived the 5 Initial Treatment sessions. Since everyone is different, it is not possible to determine exactly how many Touch-Ups will be needed for a particular area. The laser hair removal technician will recommend a subsequent appointment based on their assessment of the hair growth in the area being treated.
  4. As a General Rule, and to guarantee the results of the laser hair removal treatments, the following terms apply:

New ABA clients or existing clients who want to start laser hair removal treatment in a new area where laser hair removal treatments were done at another laser hair removal clinic in or outside Puerto Rico will be considered to be starting the Initial Treatment stage and will have to complete the series of five Initial Treatments before being considered for Touch-Up treatments. In every case, clients will be evaluated by an Aba Laser Technician who will determine, at its own discretion, whether the hair removal results observed in the area to be treated justify considering the client to be further along in their laser hair removal treatment.
  6. ABA clients who have started the Initial Treatment stage for a specific area but who: (1) have not completed the five treatments included in the Initial Treatment and choose to have laser hair removal treatments at another laser hair removal clinic in the same area previously treated at ABA, and/or (2) who do not return to ABA to complete the five treatments included in the Initial Treatment within a period of one year from the date of their last Initial Treatment at ABA (initial treatment of the area to be treated) will be considered clients who are starting  the Initial Treatment stage and must complete the series of five Initial Treatments before being considered for Touch-Up Treatments. In every case, all new ABA clients will be evaluated by an Aba Laser Technician who will determine, at its own discretion, whether the hair removal results observed in the area to be treated justify considering the client to be further along in their laser hair removal treatment.

5.3 Purchases on aba.pr

We may decline a purchase order if we are unable to obtain the corresponding payment authorizations, if there has been a pricing or product description error on the Website, and/or if the order does not meet the criteria established in our Terms and Conditions.

5.4 Return Policy

Please read our Return Policy to learn about the terms and conditions governing the return of our Products and/or Services.

5.5 Payment and Billing Information

By providing a credit card or any other payment method we accept, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the full amount of your purchase (including taxes and other applicable fees) (collectively, as the case may be, an “Order”). If the payment method cannot be verified, is invalid, or is not acceptable, your Order may be suspended or cancelled. You must resolve any problems with your payment method before proceeding with your Order. If a payment is not processed satisfactorily, you remain responsible for the uncollected amounts and authorize us to continue accounting for the corresponding amount.

  1. INFORMATION ACCURACY

Occasionally, there may be information on the Website that contains typographical errors, inaccuracies, or omissions that may be related to promotions and offers. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information or cancel orders at any moment and without notice (including after your Order has been processed) if the information on the Website or for any related Service is incorrect. We assume no obligation to update, modify, or clarify the information on the Website, including but not limited to pricing information, except as required by law. No specific updates or revision dates shown on the Website should be understood to suggest that all the information on the Website or for any related Service has been modified or updated.

  1. LICENSE TO ACCESS AND USE THE WEBSITE AND ITS CONTENT:

Unless specified in writing by us, the Website and all the content and other materials included in the Website, including, but not limited to, the ABA  logo and all the designs, text, graphics, images, information, data, software, sound files, and other files (collectively, “Content”), are the property of ABA  or of our licensors, as applicable, and are protected by the intellectual property laws of Puerto Rico and the United States.

You are hereby granted limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Website and the Content. However, such license is subject to these Terms and Conditions and does not entail any right to (a) sell, resell, or make commercial use of the Website or the Content, (b) distribute, publicly display, or exhibit any Content, (c) modify or otherwise make any derivative use of the Website, the Content, or any portion thereof, (d) use data mining systems, robots, or similar data collection or extraction methods, (e) download any portion of the Website or the Content, except as expressly permitted by us, and (f) use the Website or the Content for purposes other than those provided herein. Any use of the Website or Content not specifically authorized herein, without prior written permission from us, is strictly prohibited and will result in the termination of the license granted herein. Such unauthorized use may also be in violation of applicable laws, including but not limited to, copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated by us, nothing in these Terms and Conditions shall be construed as conferring any right or license to any patent, trademark, copyright, or other proprietary rights belonging to ABA or any third party. This license may be revoked at any time.

Notwithstanding anything to the contrary in these Terms and Conditions, the Website and the Content may include third-party software components that are subject to separate license terms, in which case those license terms will govern such software components.

  1. REPEATED INFRINGEMENTS; COPYRIGHT VIOLATIONS.

In accordance with federal and other applicable laws, we have adopted a policy of limiting Website access or terminating user accounts, that infringe the intellectual property rights of others, given the appropriate circumstances and at our sole discretion. If you believe that something on the Website infringes on copyrights you own or control, you may file a notice of this violation with our designated agent, as set forth below:

You should also be aware that if you knowingly make a false statement in your notice claiming that there is material or activities infringing your rights, you will be liable for any damages, including, but not limited to, any attorney fees and costs incurred by us or by the alleged offender as a result of us trusting such misrepresentation to remove or disable access to the material or activity that is an alleged infringement.

  1. INDEMNITY

By using the Website or purchasing and/or using any of our Products and/or Services, you agree to be bound by the strict enforcement of these Terms and Conditions and agree that any decision made by Aba Centro Electrólisis and its agents is final and binding in all respects. By using the Website, the Services, and/or the Products, you, or your successors, voluntarily assume all responsibility and risk and agree to: defend, relieve, indemnify, and hold harmless  of responsibility (collectively “Exonerate”) Aba Centro Electrólisis, its parent companies, subsidiaries, affiliates, agents, advertising and promotional agencies, and their respective officers, directors, shareholders, employees, representatives, agents, and any other entity directly related to the Website, the Content, the Services, and/or the Products offered through the Website (hereinafter and collectively, the “Released Entities”) of any and all liabilities, lawsuits, actions, claims, complaints, accidents, losses, and damages, including but not limited to personal injury (including disability, loss of income, and death) and property damages, costs, and expenses (including attorney fees) arising from (a) any use or misuse of the Website, the Content, or the Products and/or Services, whether by you or by any third party you authorize to access or use your Website Account, the Content, or the Products offered through the Website, (b) your use, possession, and/or handling of any of the Products available through the Website; or (c) the use of your computer/device to access the Website. You also (ii) Exonerate the Released Entities for any typographical, technical, or human errors, including but not limited to errors in advertising, print,or in these Terms and Conditions, or for inaccurate, incomplete, illegible, or incorrect information that leads to problems, errors, or delays in the notification, verification, or use of the Website and its Services and (iii) Exonerate the Released Entities for any human or technical errors, defects, delays, failures, breakdowns, fraud, unauthorized interventions (including hacking), or other failures in the network connections, lines, servers, the Internet, antennas, satellites, telephones, computers, fixed and wireless devices, hardware, software, programming errors, computer virus and bug problems, or other technical defects or failures that affect the transmissions/communications/notifications or that otherwise limit the user’s ability to access the Website or use the Products and/or Services.

  1. LIMITATION OF LIABILITY; RELEASE:
    To the extent permitted by applicable law, in no event shall Aba Centro Electrólisis and/or the Released Entities, as detailed in paragraph 9 of these Terms and Conditions, be liable for any indirect, special, incidental, or punitive damages of any kind (including, but not limited to, loss of income or benefits, loss of use or data, loss or decrease in value of assets or securities, or business interruption damages) arising from or related to the access or use of the Website or the Content, or the Order, receipt, or use of any Product or Service, otherwise related to these Terms and Conditions (including, but not limited to, any damages caused by or resulting from the reliance on any information obtained through the Website or from events that are reasonably out of the control of ABA, such as website outages, the deletion of files or emails, errors or omissions, defects, viruses, operation or transmission delays, or any failure, whether resulting from acts of God, communication failures, theft,  destruction, or the unauthorized access of the files, programs, or systems of ABA), regardless of the manner of action, whether under contract, tort, warranty, breach of statutory duty, negligence, or any other kind (including, but not limited to, negligence or any other legal or equitable principle, even if the party has been advised of the possibility of such damages and regardless of whether such damages were foreseeable).

To the maximum extent permitted by the applicable law, in no event shall the maximum aggregate liability of the Released Entities (collectively) arising from or related in any way to an Order and/or the receipt or use of the Products or Services available on the ABA Website exceed the amount paid by the user for such Products and/or Services. The foregoing limitations will apply even if the remedies provided herein do not meet their main objective, and the foregoing will constitute the sole responsibility and obligation of the Released Entities with regard to this agreement.

  1. APPLICABLE LAW; DISPUTE RESOLUTION; SEVERABILITY:

All agreements contained in these Terms and Conditions are subject to all the applicable laws and regulations of the Commonwealth of Puerto Rico, as well as federal law. By using the Website or the Products and/or Services, you acknowledge and accept all the terms and conditions in these Terms and Conditions, and you also acknowledge and agree to be subject solely and exclusively to the applicable laws and regulations of the Commonwealth of Puerto Rico and to any federal laws and regulations of the United States.

Any issues or concerns that may arise regarding the construction, validity, interpretation, and enforceability of these Terms and Conditions, or of your rights and obligations in connection with the Website, the Content, and the Services and/or Products, shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico and resolved by the state and/or federal courts of the Commonwealth of Puerto Rico, specifically in San Juan, to which you voluntarily submit. If any provision in these Terms and Conditions or the application of any provision to any person or circumstance is declared invalid, unenforceable, or null and void, such decision will not have the effect of invalidating or nullifying the rest of these Terms and Conditions.

  1. ACCESS TO ABA.PR :

Our goal is to ensure that this Web site is available 24 hours a day, but we will not be responsible if, for any reason, this Website becomes unavailable at any time or for any period. Access to this Website may be suspended temporarily and without notice in the event of system failure, maintenance, or repair, or for reasons beyond our control.

  1. CONTENT IN ABA.PR :

The information contained in this Website is provided “as-is” and without guarantees of any kind, either explicit or implied, including, but not limited to, implied warranties of marketability.

The Content provided in this Website should be used for informative purposes only. This Website is not intended to provide medical information and should not be relied upon by anyone for any medical purposes, diagnoses, or treatments. The testimonials found on this Website are not intended to represent or guarantee that any individual will obtain the same or similar results. The results described in the testimonials may not be typical, and individual results may vary.

  1. MISCELLANEOUS PROVISIONS:
    These Terms and Conditions constitute the entire agreement between you and ABA in connection with your access and use of the Website and your order and/or receipt and use of the Products and/or Services. These Terms and Conditions and all rights and licenses granted in them may not be transferred or assigned by you without prior written consent from ABA. No waiver of any provision in these Terms and Conditions shall constitute a waiver of such provision under any and all circumstances, be they concurrent or subsequent, and the fact that ABA  claims no right or entitlement under these Terms and Conditions shall not constitute a waiver of such right or provision. Except as otherwise provided herein, these Terms and Conditions are intended solely for the benefit of the parties and are not intended to confer rights of third-party beneficiaries on any other person or entity.
